CUP: Hendrick Wins Last Appeal
Jimmie Johnson will have his team intact...
Tom Jensen | Posted March 20, 2012 Charlotte, NC

Rick Hendrick has won 10 championships as a Sprint Cup Series team owner.
NASCAR chief appellate officer John Middlebrook today overturned NASCAR penalties levied against the No. 48 Hendrick Motorsports team for illegal C-posts discovered during pre-qualifying inspection for the Daytona 500.

The means Jimmie Johnson’s crew chief, Chad Knaus, and car chief, Ron Malec, will not face six-week suspensions and Jimmie Johnson will not lose 25 points. In Knaus’ case, the $100,000 fine still stands, the only part of the penalty left intact.

The ruling was a huge victory for Hendrick Motorsports in its second and final appeal. Last week, the National Stock Car Racing Commission denied the first appeal and today was Hendrick’s last chance.

The original penalty ruling was that the No. 48 car was found to be in violation of Sections 12-1 (actions detrimental to stock car racing); 12-4J (any determination by NASCAR officials that race equipment used in the event does not conform to NASCAR rules detailed in Section 20 of the rule book or has not been approved by NASCAR prior to the event); and 20-2.1E (if in the judgment of NASCAR officials, any part or component of the car not previously approved by NASCAR that has been installed or modified to enhance aerodynamic performance will not be permitted – unapproved car body modifications).

Knaus and Malec originally were each suspended for six Sprint Cup races and Knaus was fined $100,000.

Driver Jimmie Johnson and car owner Jeff Gordon were penalized with the loss of 25 driver and 25 owner points, respectively.

But those penalties are now history and the team will face no sanctions.

I say Hoo-rah! For the Hendrick Team lawyers! This had 'RAILROAD' written all over it.

Mr. Middlebrook has restored some faith back into me, for this sport being handled fairly. :-)

Ok, MJ, if nothing wrong was done, why does Chad still have his fine?

Re: JUSTICE IS SERVED

I might be able to answer that for ya Annalee....

To completely overturn the whole verdict would mean they ( NASCAR commission ) open themselves up to liability for the charges, if completely dismissed.

By leaving a fine... which is going to cut into Chad's hair plugs fund, is the least damage and protects themselves.

Not a lawyer... just a thought....

MJ, you may think this is good, but you know these NASCAR fans. This is going to get ugly really, really quick. Chad and JJ better have a lot of security.

Re: JUSTICE IS SERVED

ya its going to be the people that already dislike JJ and chad, and that is their right to feel that way, but everyone knows the penalties first handed out were unfair, and as i stated i can understand if or why chad got suspend, but the JJ penalty was out of line

Does anyone have a coupon for Hair Club for Men? Chad was planning on finishing his "do" this year, not next year.

Re: JUSTICE IS SERVED

Today shows what a joke the appeals process is. The NASCAR higher-ups are not happy.

Re: JUSTICE IS SERVED

I never understood how he got penalized in the 1st place. The car never even made it to preinspection. Dont get me wrong. I would have loved to have had the 48 team keep their 25 point penalty (for selfish reasons) but never saw why a penalty of any kind was given out.
Completely surprised by the verdict, but it is what it should have been along. IMHO.

So much hate for a man with so much talent. A man who doesn't need to cheat to win a championship. If by chance JJ gets his 6 pack this year I for one propose we always use an asterisk beside his name

Re: JUSTICE IS SERVED

NASCAR has a rule saying basically they can penalize team if they see something that they don't like. Either way it's all bs. The 48 can do whatever they want. The day Chad retires NASCAR will be happy.
